A woman in her thirties has been sentenced to imprisonment after falsely accusing her biological father, who had previously financed her overseas education, of rape. The accusation stemmed from his refusal to provide her with financial assistance.
As reported by the legal sector on the 1st, the Criminal Division 1 of the Namyangju Branch, under the Uijeongbu District Court (presided by Judge Choi Chi-bong), has delivered a 10-month prison sentence to a woman, known as A, due to charges that include defamation, business obstruction, and insult.

A faced trial for defamation after sharing 11 posts on an online platform between May and June of the previous year. These posts were titled "I am a victim of familial sexual violence. Please look at this," and they publicly defamed her father, B.
Within the posts, A falsely asserted that her father had continuously sexually assaulted her since she was four years old. She also claimed her mother had endured both domestic and sexual violence. Furthermore, she alleged that a settlement of 30 million won was reached and called for severe punishment.
In these postings, A disclosed B’s real name and details about his business, causing reported difficulties in its operation.
Moreover, A made six additional online claims that B had remarried a woman, C, who she alleged had been involved in an affair with him.

In February 2021, A pursued a sexual assault damages lawsuit against B in the Incheon District Court but failed to substantiate any unlawful actions.
During the criminal proceedings, A maintained the truthfulness of her statements; however, the court rejected these assertions, referencing the unsuccessful lawsuit. The court noted the absence of any concrete evidence or circumstances supporting habitual sexual assault by B.
The court concluded that A's accusations were likely false, especially in light of B’s financial support during her studies abroad and upon her return. The alleged rape accusation appeared suspiciously timed, following A's substantial monetary request for opening a cafe, which B denied.

The court stressed, "Her dissemination of false information was a response to her dissatisfaction with being refused financial aid. The reputations of the victims have suffered irreparably."
Additionally, the court justified the sentence by highlighting "a significant risk of recidivism, as A persisted in posting similar content post-crime. The victims’ strong desire for the defendant’s harsh punishment was also a critical factor in the decision."
